Refunds, returns Policy & Liability Waiver

THESE TERMS AND CONDITIONS ARE AGREED UPON AT THE TIME OF PURCHASE:

No refund policy:  Tickets will only be refunded if there is an event such as severe inclement weather, or natural disaster that prevents us from operating. ONLY IF THE CHRISTMAS FACTORY STAFF CANCELS THE SHOW, YOU MAY BE ELIGIBLE FOR A REFUND IN FULL. This policy is necessary because of our status as a live marketplace. When a purchase is confirmed, the seller removes the associated ticket from inventory. If, after purchase, the buyer decides not to attend the event, there will be no refund.

Ticket transfers:  Tickets may be transferred to a different guest if the original buyer chooses to sell or gift the tickets.

Rescheduling:  The Christmas Factory understands that conflicts may arise with your scheduled tour time. Although, we understand that unexpected circumstances can happen. If needed, a ticket can be exchanged once for another available day and time.  Please contact customer service at elves@akchristmas.com to make any changes regarding rescheduling.  

PLEASE NOTE, RESCHEDULING CAN ONLY BE OFFERED DEPENDING ON AVAILABILITY.  If the tours are sold out, the option of rescheduling is not available. 

Your tour may be rescheduled 48 hours prior to your tour time.  If your scheduled tour is within 48 hour time period The Christmas Factory will not be able to reschedule your group.  This policy is necessary because of our status as a live marketplace. When a purchase is confirmed, the seller removes the associated ticket from inventory. If, after purchase the buyer decides not to attend the event the seller will need 48 hours to provide antiquate time to fill the tickets vacancy.

IF IN THE EVENT YOU QUALIFY TO BE REFUNDED OR RESCHEDULED—If the customer does not notify THE CHRISTMAS FACTORY before the scheduled tour time, neither refund nor rescheduling can occur.  IF, AFTER PURCHASE, THE BUYER DECIDES NOT TO ATTEND THE EVENT, THE TICKET WILL NOT BE REFUNDED. IF FOR ANY REASON YOU ARE LATE FOR YOUR TICKETED TIME, YOUR TICKETS ARE NON-REFUNDABLE.

All attendees will be required to treat the property of the Alaska State Fair Grounds, the Christmas Factory, the actors, and all employees with respect. The Christmas Factory has the right to escort anyone in violation of this policy from the property, without a refund.

In the event that a live Reindeer is on location: you have agreed to these terms and policies REINDEER  INTERACTION LIABILITY WAIVER

Warning:  By selecting to agree to the terms and conditions you give up the right to sue for any injury or damages howsoever caused, The Christmas Factory located in Palmer, Alaska.  The owner’s, employees, representatives officers, and agents here and after referred to collectively as employees.

I hereby agree on behalf of myself, and my child, my personal relatives, heirs and assigns.

1. I agree as a precaution to my participation in the reindeer exhibit of The Christmas Factory and all other interactions with reindeer at this event. To be strictly bound by the terms of this waiver assuming risk of indemnity agreement.
2. I acknowledge that petting of the reindeer at the reindeer exhibit involves inherent risks that may cause serious injury and possibly death to participants.
3. I fully understand the risks and dangers associated with my child’s or my personal representative, heirs, or assigns participation in The Christmas Factory Reindeer exhibit and accept same entirely at my own risk.
4. I hereby waive any and all claims, which I may have against The Christmas Factory, and/or its employees and release The Christmas Factory and its employees from all liability for injury, death, property damage, or any other loss sustained by me or my child (or the child I am representing) as a result of my/their participation in the event, due to any cause whatsoever including, without limitation, negligence on the part of The Christmas Factory, it’s employees, for any and all legal fees (on a solicitor and his own client basis) or costs, which may be incurred in defending any lawsuit or claim I may bring against them.
5. I appreciate that this agreement applies whether the Christmas factory is at fault or not, and it limits the liability of the employees to the same extent as it limits the liability of the Christmas factory even though the employees are not formal parties of disagreement. I understand, furthermore, that the Christmas factory in securing execution of this agreement by myself it’s acting as agent or trusty on behalf of or for the benefit of the employees who shall to this extent be or be deemed to be parties of this agreement.

By checking the Terms and Liability Waiver at checkout I acknowledge I have read and understand this agreement, I understand that this document contains a promise not to sue The Christmas Factory or the employees and release and indemnify the same for all claims.
